Bonifiche, speculazioni immobiliari e 'ndrangheta
«I conti non tornano nel declassamento della “Lombarda Petroli” nelle categorie di rischio previste dalla Direttiva Seveso» affermava il Ministro dell’Ambiente Stefania Prestigiacomo a seguito dell’ultimo disastro ambientale causato da uno sversamento nel fiume Lambro, annunciando altresì una indagine interna. Qualcuno ne sa qualcosa, magari a “Chi l’ha visto?”. Così ci sono altre domande inevase: Come sono stati fatti i controlli? Al di là delle verifiche degli adempimenti fiscali chi ha controllato le autocertificazioni? Lo sversamento dei liquami tossici nei corsi d’acqua ha una evidenza eclatante ma la relazione inquinamento-controlli-bonific
Nel 2010 a Milano sono state sequestrate aree oggetto di grandi interventi di riqualificazione urbanistica su siti industriali dismessi: Santa Giulia, Calchi Taeggi e Bisceglie. Perché costruire su un terreno inquinato? Chi lì ha comprato casa, con i sacrifici del caso, è preoccupato e indignato e vuole capire quali sono le soluzioni e chi sono i responsabili, si delinea così un circuito amministrativo, economico, normativo che produce e che prospera su questi pasticci e gli attori in gioco sono vari. I promotori delle iniziative immobiliari, che hanno investito miliardi (più delle banche che loro) a seguito del rilascio di provvedimenti amministrativi e permessi legittimi. Le Amministrazioni locali, Regione, Comuni e Provincie, che eseguono le istruttorie, approvano i progetti di bonifica e ne certificano il risultato finale. Gli organi tecnici della pubblica amministrazione, ASL e in particolare ARPA, che esprimono i pareri tecnici per il rilascio degli atti amministrativi. L’Autorità Giudiziaria, a cui spetta la verifica della corretta applicazione delle leggi. Magistratura inquirente e poi giudicante (nella triplice modalità: civile, penale ed amministrativa), che a sua volta si avvale di propria polizia giudiziaria e di propri consulenti tecnici, professionisti o tecnici di ARPA e ASL. Ci sono scelte di regolazione e di pianificazione che spettano ai vari livelli di governo, dovrebbero essere scelte di indirizzo politico, specie se emergono problemi importanti. Qui il Sindaco, il Governatore ed il Presidente della Provincia, hanno sostenuto, che i loro uffici avrebbero agito in conformità alle leggi (ovviamente) e che, comunque, non era compito loro verificare la correttezza dei pareri tecnici, ma dei competenti organi (ASL e ARPA in particolare). Infine non dobbiamo ricordare degli attori della cui presenza apprendiamo dalle cronache giudiziarie ma sono presenti: le mafie, a partire dal ruolo assunto in alcune movimentazioni di terreni. Per capire come funziona il circuito con i diversi attori osserviamo il caso Calchi Taeggi con la bonifica di una discarica incontrollata di rifiuti pericolosi e l’ adiacente, autorizzato, intervento edilizio di riqualificazione.
E’possibile la bonifica di un’area industriale senza portare via un chilogrammo di rifiuto e/o terreno contaminato? Sì per il D.lgs 152/06 Testo Unico ambientale Berlusconi/Matteoli) e il nuovo metodo di valutazione dell’inquinamento: l’analisi di rischio-AdR. Un calcolo matematico, che, partendo dai livelli di contaminazione misurati, ricava delle concentrazioni accettabili per l’uso previsto dell’area, Concentrazioni di Soglia di Rischio – C.S.R.. Tali concentrazioni dovrebbero causare non più di 1 morto di cancro ogni 100.000 abitanti e contemporaneamente non causare l’eritema a tutti gli altri. A presentare l’AdR è la “Ditta” che vuole effettuare un intervento in un’area oggetto di contaminazione. L’ARPA, l’organo tecnico che deve valutare l’AdR della “Ditta, a garanzia della collettività, deve verificare la correttezza delle informazioni e dei dati utilizzati dalla “Ditta” nell’AdR, perciò effettua i campionamenti, le analisi, le misurazioni. Poi le valida e le elabora. Una mole enorme di informazioni che spesso non si possono raccogliere nella loro interezza perché, le spese per la tutela dell’ambiente nei bilanci pubblici sono marginali. Con strumenti, risorse economiche ed umane, non proporzionate all’assoluta rilevanza quantitativa e qualitativa delle bonifiche, che di volta in volta devono essere valutare nelle varie AdR proposte dai privati, l’istruttore della pratica dovrà fare ricorso ai “dati di letteratura” e a quelli della “Ditta” proponente, sperando che siano veri. Cambiando una virgola di una sola delle proprietà chimico/fisiche dei dati in ingresso, i risultati finali di una AdR possono variare di diversi ordini di grandezza... Il fatto che per l’AdR ci possano essere margini valutativi può presentare conseguenze per i singoli funzionari: dall’incubo di procedimenti giudiziari perché le “Ditte” potrebbero portare in tribunale i funzionari pubblici che hanno dato un diniego preventivo, con richieste milionarie di danni; alle pressioni sulle posizioni apicali direttamente di nomina della politica regionale, Basterebbe verificare tra i funzionari di ARPA che si occupano di bonifiche quale sia l’importo delle assicurazioni private che hanno sottoscritto. Pensiamo poi alla possibile corruzione messa in atto dalle varie ‘ndrine radicate anche al nord, magari anche loro della partita e che, a fronte di un rifiuto, potrebbero non accontentarsi di minacce di trasferimento e penalizzazioni di carriera.
Quando i funzionari pubblici non sono degli stinchi di santo, come ad esempio l’ex Direttore Sanitario dell’ASL di Pavia, le soluzioni pasticciate, o peggio, sono conseguenti. Qui la normativa messa a punto dal legislatore invece di essere ferma permette ai furbi di farla franca legittimamente.
Così il precedente Decreto Ronchi Assetto art. 51 bis decreto Ronchi prevedeva l’obbligo di bonifica anche in caso di eventi di inquinamento del tutto accidentali e l’obbligo di ripristino ambientale sorgeva non solo in caso di superamento dei valori di soglia previsti dalla legge ma anche allorché si fosse determinato il semplice pericolo di tale superamento. L’inquinamento o il pericolo di inquinamento non erano i presupposti della condotta, mentre il fulcro dell’illecito era ravvisato nella mancata bonifica del sito contaminato. Le modifiche attualmente in vigore hanno eliminato ogni riferimento al pericolo concreto e attuale di inquinamento, che dunque rimane estraneo alla sanzione penale e l’elemento costitutivo del fatto illecito è solamente il fatto di inquinamento determinato secondo l’innovativo sistema di superamento delle “concentrazioni soglia di rischio”, che abbiamo visto prima e sono più elevate delle concentrazioni di soglia della vecchia disciplina. Ora la procedura di bonifica attuata tempestivamente costituisce una clausola di esonero dalla pena, di più: se il ripristino dell’ambiente viene conseguito dal responsabile attraverso una procedura di pari efficacia di quella prescritta, non potrà essergli ascritta alcuna responsabilità penale per il mancato rispetto della procedura amministrativa. Ora la norma consente di evitare ogni implicazione penale a fronte della bonifica a prescindere dal tipo di illecito ambientale che ha dato origine alla contaminazione. Infine il Polo chimico di Marghera ha fatto norma: l’acquirente non risponde, per il solo fatto di subentrare nella titolarità del potere di disposizione sull’area della mancata rimozione dello status di contaminazione causato da fattori pregressi. Infine, ora in un’area contaminata da veleni i valori di concentrazione soglia di contaminazione- CSC sono quasi sempre superiori ai valori soglia di contaminazione, ma un’analisi AdR può dare come risultato finale una contaminazione inferiore ai valori di concentrazione della soglia di rischio-CSR. Quindi, avremo ai sensi dell’Art. 240, un sito non contaminato! L’Art.242 nel progetto operativo degli interventi di bonifica consente, in alternativa, la messa in sicurezza, operativa o permanente che prevede di non allontanare dal sito i rifiuti e/o i terreni contaminati. Con le modifiche vigenti per condannare un inquinatore di terreni occorre avere entrambi i presupposti:un AdR che dimostri che l’inquinamento causato è maggiore delle CSR; che ci sia un progetto di bonifica approvato dall’autorità competente;che la bonifica non venga fatta. Se poi la bonifica ci costasse troppo, con un fallimento ben studiato e buoni legali, la prescrizione sarebbe alla portata. La bonifica si può, quindi, approvare senza dover allontanare i rifiuti, ma almeno sarà vietato costruirci sopra una casa? No non è espressamente vietato, la “Ditta” può chiedere di edificare in aree contaminate o nelle immediate vicinanze e chi di competenza nella Pubblica Amministrazione deve valutare la richiesta. In questo caso, non esistendo un indirizzo univoco, valido per tutta la Regione, tutto dipende da un funzionario e l’ultimo che firma appartiene ad ARPA Lombardia.Possiamo immaginare il dilemma di un Dirigente ARPA che si trovi di fronte ad un caso del genere: meglio un ricorso al TAR da parte della “Ditta”e forse una causa civile per danni (ed ovviamente il blocco della carriera), oppure, fra qualche anno, l’azione di qualche Procuratore della Repubblica? Nel caso Calchi Taeggi, il progetto di bonifica avrebbe dovuto essere approvato dalla Regione su parere della Provincia ma, con un’apposita Legge Regionale, lo stesso è stato “devoluto” al Comune. Mentre per il parere a carico della Provincia, la stessa, a sua volta, si avvale della competenza tecnica di ARPA. A Milano, in particolare, la Provincia si è convenzionata, integralmente, con ARPA. Quindi, in pratica, il parere lo fa ARPA. La Provincia emana solamente l’atto amministrativo. La Provincia è delegata inoltre, in base all’art. 248 del citato TU ambientale, alla certificazione finale della bonifica, sempre sulla base di una relazione tecnica predisposta ARPA. Così ARPA Milano è diventata controllato e controllore. Da organismo tecnico di verifica e controllo, si carica anche di buona parte dell’iter amministrativo e delle relative responsabilità. Abbiamo autorizzato la costruzione di un quartiere sulla discarica? L’ARPA ci ha detto che era possibile…. Le evidenze emerse anche in altre inchieste danno l’idea di un sistema gelatinoso, borderline tra legalità, incompetenza e comportamenti dolosi. E’ un esempio l’inchiesta in cui sono coinvolti “il re delle bonifiche” Grossi, amico della moglie di Abelli, a sua volta big della politica lombarda nazionale e regionale, il potentissimo Direttore dell’ASL di Pavia, di selezione politica, che sognava fin da piccolo di fare il ‘ndraghetista sic! La gestione di una partita cruciale per la nostra qualità della vita e per quella dei nostri figli, come la bonifica delle discariche selvagge che ci hanno lasciato i nostri padri, è il paradigma dell’organizzazione della cosa pubblica lasciata a se stessa. Di una normativa prodotta in modo sconsiderato da “Politici” senza visione, buon senso, competenze minimali, che non sanno nemmeno circondarsi di consiglieri preparati. Un assalto alla diligenza condotto da interessi particolari che determina stratificazioni di norme inapplicabili, pro o contro singoli interessi economici e professionali. Un circuito folle nel quale le competenze tecniche vengono mortificate e intimidite, assolutamente permeabile all’azione della malavita organizzata. Ora è più chiaro il perché di una edificazione su un sito contaminato non bonificato. Che insieme alla consapevolezza aumenti la nostra indignazione e la richiesta di una politica pubblica pulita.
APPELLO PER UNA PARTECIPAZIONE ATTIVA
Le primarie hanno evidenziato - accanto ai partiti del centro sinistra e a esperienze civiche come la lista Uniti con Dario Fo per Milano - anche una molteplicità di soggetti non istituzionali, espressione di una società non rassegnata che molto ha contribuito al successo della consultazione popolare, sia attivamente nella campagna sia altrettanto attivamente con il voto a quei candidati che hanno identificato come portatori di un progetto vicino al sentire delle persone.
Sono associazioni, comitati, movimenti, gruppi e singoli cittadini attivi che caparbiamente continuano e continueranno ad impegnarsi per cambiare volto a questa città, nei quartieri, nelle scuole, nelle università, nei centri sociali e culturali.
Molte di queste realtà faticano a far sentire la loro voce, non si considerano rappresentate dai partiti politici, né di sinistra né di centro, e sempre più si rifugiano nell’area diffusa dell”astensionismo attivo” o “polemico”; devono invece trovare finalmente espressione e rappresentanza reale, oggi nell’impegno per sconfiggere il centro-destra e domani nel nuovo governo della città.
E’ necessario quindi costruire un ambito largo, unitario e aperto ma chiaramente connotato a sostegno del candidato sindaco Pisapia che completi l’arco della rappresentanza politica e sociale della coalizione e sia così utile per la vittoria elettorale.
Un ambito nel quale le molteplici esperienze diffuse sul territorio si possano riconoscere ed esprimere, in un progetto di cittadinanza fondata su valori comuni e non su interessi, su solidarietà e non su egoismi, su partecipazione e non su sudditanza a poteri altri; per affrontare con trasparenza ed efficacia le grandi questioni dello sviluppo urbanistico e della dimensione metropolitana della città, in cui si inseriscono le diverse problematiche sociali, culturali, ambientali sulle quali devono avere voce i cittadini che quotidianamente le affrontano.
E’ una proposta per contribuire attivamente alla vittoria di Giuliano Pisapia, ma che non si limita a un’aggregazione funzionale a questo obiettivo: invita a guardare anche oltre, e si configura come premessa per la costruzione di uno ‘spazio comune permanente’ dove tutti i soggetti e le esperienze attive nella nostra città destinatari di questo appello si possano incontrare, confrontare, coordinare e organizzare proposte e iniziative, superando la frammentarietà che è spesso di ostacolo all’essere riconosciute come una risorsa – e non un problema - per la città e le sue istituzioni.

Fondazione RIVOLTA IDEALE
Questa mattina, a Roma, nella sala del Senato dedicata ai Caduti di Nassurya, è stata ufficialmente presentata la Fondazione Rivolta Ideale che nasce dall’incontro fra le varie Associazioni che raggruppano gli ex dirigenti giovanili e nazionali del Msi.
Amici del Fuan, Amici della Giovane Italia, Centro iniziative sociali, Donne per la Fiamma Tricolore, Laut, Raggruppamento giovanile studenti e lavoratori e Volontari nazionali, sono le associazioni che hanno dato vita alla Fondazione Rivolta Ideale, alla quale hanno dato la loro adesione numerosi ex parlamentari del Msi di Camera, Senato e Parlamento Europeo, oltre a tutti gli ex dirigenti delle disciolte organizzazioni missine degli anni ’50, ’60 e ’70.
Promotori della iniziativa sono due storici esponenti della destra missina: il Senatore Domenico Gramazio (Presidente) ed il Senatore Ajmone Finestra (Presidente Nazionale della Unione Combattenti della RSI, già Sindaco di Latina-Littoria) nominato Presidente Onorario.
Alla affollatissima conferenza stampa erano presenti, fra gli altri: Massimo Anderson, Adalberto Baldoni, la vedova di Giulio Caradonna, il Conte Fernando Crociani Baglioni, Raffaele Delfino, Massimo Magliaro, Stefano Menicacci, il Generale Mario Palombo, Gianni Rossetti, Alberto Rossi e Luigi Turchi.
Hanno portato il loro saluto il Presidente del Consiglio, Silvio Berlsuconi, e Maurizio Gasparri, Capogruppo del Popolo della Libertà al Senato.
Roberto Jonghi Lavarini ed il Comitato Destra per Milano, hanno subito aderito alla importante iniziativa politico-culturale, rendendosi disponibili a rappresentare la Fondazione Rivolta Ideale in Lombardia.

Esattamente, come è stato previsto circa 60 anni fa…
E’ una questione di Storia ricordare che,

Il convegno, rivolto prioritariamente ai docenti della scuola primaria e secondaria inferiore, vuole costituire un'occasione di formazione, informazione, confronto e dibattito per i docenti, non limitata al tema dell'alfabetizzazione informatica, che nella scuola di solito caratterizza la formazione e l'aggiornamento dei docenti sulla ICT.
La scuola, come agenzia e luogo privilegiato della formazione, si sta irreversibilmente modificando. Lo spazio fisico dell'apprendere e gli oggetti culturali che costituiscono il mix formativo vengono ridefiniti dalle nuove tecnologie, che trasformano le modalità gutenberghiane dell'apprendimento: le lezioni frontali e i libri vengono affiancati da PC, Internet, iPod, lavagne digitali, e-learning. Bambini e studenti apprendono l'uso dei nuovi media nei contesti extrascolastici e queste esperienze modificano profondamente il loro approccio agli strumenti culturali.
Ai docenti è chiesto di ripensare il proprio ruolo e la propria funzione alla luce di questo "cambiamento epocale", che li sfida ad adeguare i propri strumenti educativi e didattici.
In particolare è importante la scelta degli organizzatori di indagare l'attualità e il valore dell' "esperienza" su cui si fondano le didattiche attive e considerare come il "fare esperienza" rappresenti una modalità per connettere apprendimenti formali ed informali. Risulta perciò coerente che il convegno metta gli insegnanti in relazione con le riflessioni teoriche e le ricerche più innovative, proposte da esperti di indubbia fama, che si occupano da sempre di questi temi con contributi originali e che i docenti abbiano l'opportunità di dialogare con gli esperti attraverso osservazioni e domande scaturite anche dalla pratica didattica quotidiana. Le relazioni di Reggio e Rivoltella, dell'Università Cattolica di Milano, Ferri e Garzia, dell'Università Milano-Bicocca, in un contesto interattivo come quello proposto, prefigurano una modalità di alfabetizzazione digitare/reticolare adeguata perché immediatamente inerente con l'esperienza quotidiana degli insegnanti. Costituisce così un buon utilizzo della rete digitale la trasmissione dei lavori in streaming in tempo reale, che permetterà così di seguirli anche ai docenti delle altre province e regioni italiane. ... purtroppo la Giunta di questa amministrazione di centro-destra ha approvato il progetto nonostante le criticità denunciate dal Comitato per la difesa di piazzale Lavater.
... purtroppo siamo in Italia e dell'ennesimo scempio a Milano non risponderà nessuno, ma i danni saranno subiti dai cittadini, dai bambini che frequentano la scuola e dai commercianti che rischieranno il fallimento

Fuori da ogni demagogia insita nella semplificazione dello scontro politico, credo che il senso della partecipazione alla manifestazione promossa da tante donne, almeno il mio, risieda nella reazione all'insopportabile manipolazione del significato delle parole e delle azioni simboliche. Così chi propugna il "family day paga per il sesso" ( così sarebbe comunque libero?) e chi è contro la 194 e la RU 486 organizza una iniziativa a favore del satrapismo senile dove la libertà sessuale è direttamente proporzionale al potere d'acquisto e di scambio, salvo inasprire, in Parlamento, le pene per il reato di prostituzione. C'è la necessità di uscire dalle simulazioni e dalle dissimulazioni, la libertà, il rispetto delle differenze parte dalla verità e dalla non subordinazione, pagata o meno.

Comunicato corteo per Sonia
Domenica 30 gennaio è tragicamente scomparsa, investita in un incidente stradale a Milano, Sonia Bonacina, attrice e interprete dello spettacolo “Le furberie di Scapino” di Moliére, con la regia del compagno Roberto Trifirò, in programma al teatro Out Off di Milano dal 15 al 20 febbraio. Lo spettacolo è organizzato dall'Associazione culturale Figli di Nessuno di Milano, di cui Sonia (insieme a Marco Graffeo, Donato Mazzarella e Alberto Bassi) era la fondatrice.
Sonia Bonacina si era avviata precoce al teatro. Da anni lavorava come attrice e assistente alla regia con Roberto Trifirò, con Teresa Pomodoro e con Monica Conti. Dal 2010 era anche doppiatrice italiana del personaggio di Haru Miura del cartone animato giapponese Tutor Hitman Reborn.
Una tragedia, quella del fatale incidente, che ha profondamente colpito non solo chi conosceva Sonia, ma anche i cittadini e l'opinione pubblica, tanto da suscitare una reazione emotiva nazionale.
Anche per questo il regista, l'Associazione Figli di Nessuno e la famiglia hanno deciso di rappresentare comunque lo spettacolo in cartellone e di dedicarlo alla memoria di Sonia.
Il Teatro Out Off organizzerà il 15 febbraio un’iniziativa pubblica per esprimere il proprio cordoglio, ma anche per manifestare così un gesto di profonda riflessione su questa tragica vicenda.
Alla manifestazione sono invitati a partecipare, oltre al mondo teatrale milanese e alla cittadinanza, i rappresentanti delle Istituzioni. L’Assessore alla Cultura del Comune di Milano Massimiliano Finazzer Flory al momento ha già dato la sua adesione.
